Resolution to Establish HCC

The following Resolution was part of the Minutes of a Special Meeting of the Board of Education of the Houston Independent School District, on April 26, 1971.

A Resolution by the Board of Trustees of the Houston Independent School District ordering an election to be held within the boundaries of the Houston Independent School District on the 18th day of May, 1971, for the purpose of submitting to the qualified electors of the Houston Independent School District a proposition for the establishment of the Houston Independent School District Community Junior College District, designating the polling places for the election and containing provisions deemed advisable by the Board of Trustees or incident and relating to the subject.

WHEREAS, the Houston Independent School District was created and incorporated under a special law passed by the 38th Legislature of the State of Texas and approved on March 20, 1923, and as amended;

WHEREAS, Chapter 51, Subchapter B, of the Texas Education Code, provides that an independent school district junior college district may be established by an independent school district;

WHEREAS, a petition praying for an election, signed by five (5%) of the qualified electors of the Houston Independent School District was presented to the Board of Trustees who passed upon the legality and genuineness of the petition and forwarded the petition to the Coordinating Board, Texas College and University System;

WHEREAS, the Coordinating Board, Texas College and University System, meeting in Austin, Travis County, Texas, on the 23rd day of April, 1971; endorsed the establishment of the Houston Independent School District, Community Junior College District and authorized the Houston Independent School District Board of Trustees to proceed further in the establishment of the junior college district,

THEREFORE, BE IT RESOLVED AND ORDERED BY THE BOARD OF TRUSTEES OF THE HOUSTON INDEPENDENT SCHOOL DISTRICT THAT:

An election be held within the boundaries of the Houston Independent School District on May 18, 1971, between the hours of 7:00 o’clock a.m. and 7:00 o’clock p.m. for the purpose of determining whether or not the Houston Independent School District Community Junior College District shall be created and formed as provided in Chapter 51, Subchapter B, of the Texas Education Code. The boundaries of the Houston Independent School District Junior College District, if created and formed, will be coextensive with the legally recognized boundaries of the Houston Independent School District and such boundaries are herein incorporated by reference as the boundaries of the Houston Independent School District Community Junior College District.

BE IT FURTHER ORDERED THAT:

The President and Secretary of the Board of Trustees of the Houston Independent School District, be and they are authorized and directed to give due notice of such election in the manner and for the time required by law. The official ballot shall have printed upon it substantially the following:

ELECTION ON THE ESTABLISHMENT OF THE HOUSTON INDEPENDENT SCHOOL DISTRICT COMMUNITY JUNIOR COLLEGE DISTRICT.
